Abstrak
The attempt of the implementation of dwelling time reduction has been carried out in several ports in Indonesia. One of the causes of high dwelling time in ports is the overlapping of the regulations that occur. At present, the Port of Indonesia will be decreased from 200 permits at the port into only several very important permits. The relatively small and narrow port of Singapore for example, has used this kind of concise permit pattern. The Port of Singapore only has an average dwell time of 1 (one) day, while Tanjung Priuk Port has it for up to 6 (six) days. The same implementation was also carried out at the Teluk Bayur Port, as an example of a pilot location. This trial is carried out with a pattern of complying with international and national law rules and establishing Port rules that reduce this dwell time. Overlapping arrangements so far have had a significant impact on the addition of Indonesian port dwelling time. Whereas this position can be reduced by modifying the implementation and improvement of existing legal rules. The law can be a means of repairing the port through the legal theory of Mochtar Kusumatmadja's development that the law can be a means of development. This is stated in Article 1 paragraph 7 of Law Number 7 of 2009 concerning Shipping which states that port is everything related to the implementation of port functions to support and encourage national and regional economies while still considering the spatial layout. In 2017 Indonesia has entered into an era of ASEAN Economic Community cooperation. One of the issues that can be put forward by Indonesia is the strengthening of the port of the members so that it can increase into equal competitiveness with the main ports members. ASEAN Member countries such as Singapore and Malaysia can share their experience in managing ports so that they can trigger dwelling time reduction in ports in Indonesia
